Kericho MCAs impeach Governor Erick Mutai over gross misconduct

His impeachment comes even after a court injunction was issued, which prohibited the assembly from proceeding with the impeachment process until a petition filed by the governor is heard and determined.
Kericho Governor Erick Mutai has been impeached after 31 out of 47 members of the County Assembly voted in favour of a motion that cited gross constitutional violations, abuse of office, and mismanagement of public resources.
The motion was tabled by Sigowet Member of County Assembly (MCA) Kiprotich Rogony, leading to a dramatic session.

Governor Mutai had been expected to defend himself against the accusations but did not attend the session. Instead, he sent a legal team, led by lawyer Katwa Kigen, to represent him.
His impeachment comes even after a court injunction was issued, which prohibited the assembly from proceeding with the impeachment process until a petition filed by the governor is heard and determined.
Justice Joseph Sergon’s ruling required all parties to file and exchange responses and submissions within 10 days, with oral highlights scheduled for October 15, 2024.
“The parties are to file and exchange their written submissions within 10 days from the date of services of the responses by the respondents,” Justice Sergon ruled.
“Pending the inter partes hearing of the motion dated October 1, 2024, interim conservatory orders are issued against the respondents jointly or severally from suspending and staying the debating considering or acting upon the notice tabled on September 29, 2024, and the motion moved on September 24, 2024, for the removal of the applicant – Governor from the office,” Justice Sergon directed.
Despite a court order halting the proceedings, the County Assembly proceeded with the impeachment after the order was allegedly not served on time.
Among the accusations, Rogony alleged that Governor Mutai led a mob to illegally seize private land in Kericho town, intending to turn it into an unauthorised dumpsite. He further accused the governor of forcing women into inappropriate sexual activities.
The governor through his legal team has dismissed the claims.
The Senate will now determine Governor Mutai’s political future, as the county assembly speaker is expected to notify the legislative body of the impeachment decision formally.
